Real Estate Cold Calling Data in India: The 2026 Rules and What Works Instead
Last updated: 14 October 2026
Real estate cold calling data is easy to buy in India. Sellers offer Excel sheets of “HNI buyers”, “investors” and “NRI leads” by city for a few thousand rupees. Using that data has become much riskier. Under TRAI’s Telecom Commercial Communications Customer Preference (Second Amendment) Regulations, 2025, a sender reported by five or more people in ten days can have every phone line barred for 15 days. A repeat offence means all telecom resources are disconnected for a year and the sender is blacklisted. The Digital Personal Data Protection Act, 2023 adds a second layer once its main obligations apply.
This guide explains the rules in plain language, why bought data usually performs badly anyway, and what brokers and builders can use instead.

What you get when you buy real estate cold calling data
Bought lists tend to share the same problems:
- No consent. The people on the list never agreed to hear from you about property.
- Resold many times. The same sheet is sold to many brokers in the same city, so these numbers get called again and again.
- Old and mixed. Lists are stitched from old portal leads, event registrations and other sources. Many numbers are switched off, changed or belong to people who bought a house years ago.
- DND numbers. Many subscribers have registered preferences against commercial calls.
The cost of the sheet is small. The real cost is the telecaller’s time, and now the risk to your phone numbers.
TRAI’s 2025 rules in plain words
TRAI notified the second amendment to its commercial communication regulations on 12 February 2025. The parts that matter to a property office:
| What happens | Consequence |
|---|---|
| Complaints against a sender from 5 or more people in 10 days | Outgoing services on the sender’s lines suspended while the operator investigates |
| First confirmed violation | Outgoing services on all the sender’s telecom resources barred for 15 days |
| Second and later violations | All telecom resources disconnected for one year, sender blacklisted, devices used blocked for a year |
| Unregistered telemarketers | Warning, then a usage cap of 20 calls and 20 messages a day for six months, then disconnection of up to two years |
| Promotional robocalls and auto-dialler calls | Only through the 140-series numbers |
Customers can complain within seven days of receiving the call, which is a shorter window than before. So a single bad week of calling a bought list can take out the whole office’s numbers, including the one printed on your hoardings and Google Business Profile.
The safe route for promotional calls is registration as a sender with your telecom operator and calling only people who have agreed to hear from you.

The DPDP Act: the second layer
The Digital Personal Data Protection Act, 2023 governs how businesses collect and use personal data, including phone numbers and names. The Ministry of Electronics and IT notified the DPDP Rules on 13 November 2025. Most of the substantive obligations come into force in phases, with the bulk applying from around May 2027.
In plain terms, once those obligations apply, a business generally needs a lawful basis, usually consent given for a specific purpose, before it uses someone’s personal data. A list bought from a stranger rarely comes with consent for your business to call about your project. The Act’s schedule allows penalties of up to Rs 250 crore for the most serious failures. Get advice from a lawyer on how the rules apply to your business. The direction is clear, though: data people gave you directly, for a stated purpose, is safer than data you bought.
Bought data vs your own enquiries
| Bought cold calling data | Your own enquiries | |
|---|---|---|
| Consent | Usually none for your business | Given when they enquired |
| Freshness | Old, resold, mixed | Fresh, about your project |
| Pickup rate | Low, many switched-off or wrong numbers | Higher, they expect your call |
| Legal risk | TRAI complaints, DPDP exposure | Low when handled properly |
| What it costs | A cheap sheet plus a lot of telecaller time | Ad spend or portal fees per lead |
Calling your own enquiries still needs speed. The value of a lead drops fast if nobody calls back within minutes. Our guide to speed to lead in real estate explains how quickly to call and why.
What works instead
- Lead form ads on Meta. The buyer fills a form with their own number and agrees to be contacted. Add a question that filters out time-wasters. See real estate cost per lead in India for realistic budgets.
- Google search ads. People searching “2 BHK in Kharar” or “plots near Ludhiana” are already looking. You pay for clicks from active buyers instead of calling strangers.
- Portal leads. 99acres, Magicbricks and Housing send enquiries from buyers who chose your listing.
- WhatsApp opt-in. A click-to-WhatsApp ad starts a conversation the buyer opened, which is much easier to follow up.
- Your own past enquiries. Old enquiries in your CRM or phone are worth re-contacting with a new project, as long as they asked about property from you.
When the lead does come in, a good first call matters more than the list. Our real estate calling script in Hindi gives a structure that works for both new and old enquiries. If the leads you get look fake, this diagnosis guide helps you find out why.
Tired of dialling numbers that never pick up? Message us on WhatsApp. We run Google and Meta lead campaigns for real estate businesses in Punjab and Haryana, so your telecallers call people who actually asked about property.
If you still call cold
Some offices will keep making outbound calls. If you do:
- Register with your telecom operator as a sender for commercial calls, and use the series it assigns.
- Never use an auto-dialler on ordinary 10-digit numbers for promotional calls.
- Stop calling anyone who says no, and keep a do-not-call list.
- Keep your main business number off cold-calling duty, so one complaint wave cannot cut it.

FAQ: real estate cold calling data
Is it legal to buy real estate cold calling data in India?
Buying a list is not the main risk. Using it is. Promotional calls to people who have not agreed to hear from you can trigger complaints under TRAI’s 2025 rules, and the DPDP Act will generally need a lawful basis such as consent to use personal data.
What is the penalty for unsolicited sales calls in India?
Under TRAI’s 2025 amendment, a first confirmed violation bars outgoing services on all the sender’s lines for 15 days. Repeat violations lead to disconnection of all telecom resources for one year and blacklisting.
Which number series must be used for promotional calls?
TRAI says promotional robocalls and auto-dialler calls should use 140-series numbers, and service and transactional calls should use the 1600 series or another series allotted for that purpose.
When does the DPDP Act apply to real estate businesses?
The DPDP Rules were notified on 13 November 2025, with most substantive obligations phased in over 18 months, to around May 2027. Take legal advice on your specific case.
What is a better alternative to real estate cold calling data?
Leads people give you directly: Meta lead form ads, Google search ads, portal enquiries and click-to-WhatsApp ads, called back quickly with a good script.
The short version
Real estate cold calling data is cheap to buy and expensive to use. TRAI’s 2025 rules can bar or disconnect every number your office uses, and the DPDP Act is moving India toward consent-based data use. Put the same money and telecaller time into leads that people give you themselves, and call them back fast.
