An Occupancy Certificate (OC) is a legal document issued by the local municipal or development authority — in Punjab that means GMADA for most of the Tricity and Mohali area, the Municipal Corporation for city limits, or PUDA and its sister authorities elsewhere. It certifies two things: that the building was constructed according to the sanctioned plan, and that it is safe and fit to occupy, with proper civic infrastructure — water, sanitation and electricity — in place.

In plain terms: the OC is the government saying “this building is legal, and people are allowed to live in it.” Without it, your flat may be physically ready but legally unauthorised — and that gap is where buyers lose money.

OC vs Completion Certificate — the difference that confuses buyers

Buyers often hear both terms and assume they are the same. They are not. Under Section 2 of the RERA Act, 2016, a Completion Certificate (CC) certifies that the project has been developed according to the sanctioned plan, layout and specifications. The Occupancy Certificate (OC) then permits actual occupation of the building. The simplest way to remember it:

  1. Ask the seller or builder for a copy of the occupancy certificate (and completion certificate). A genuine seller will have it; reluctance to share is itself a red flag.
  2. Check the issuing authority and date on the document — GMADA, the Municipal Corporation, or the relevant development authority — and confirm it matches the project and building.

What RERA says — and what to do if the builder stalls

Under the Real Estate (Regulation and Development) Act, builders are legally obligated to obtain the occupancy certificate and hand it to buyers at the time of possession. If a developer takes possession money but does not provide the OC, you are not without recourse. You can file a complaint with PRERA (the Punjab Real Estate Regulatory Authority), which has the power to investigate, penalise the developer, direct them to obtain the OC, and award compensation to affected buyers. FAQ — occupancy certificate in Punjab

Can I live in a flat that has no occupancy certificate?

Physically yes, legally no. Occupying a building without an OC means the authority can treat it as unauthorised, deny you permanent utilities, and in serious cases issue penalty or eviction notices. It also makes future resale and loans much harder.

Is a completion certificate enough if there is no OC?

No. A completion certificate confirms the building was finished per the sanctioned plan, but it does not, by itself, permit occupation. The occupancy certificate is the one that legally allows people to live in the building, so insist on the OC specifically.

Does resale property need an OC too?

Yes. Whether the flat is new or resale, ask for the OC. If a resale seller cannot produce it, the building may never have been regularised — which becomes your problem the day you try to sell or mortgage it.

Who issues the OC in Mohali and Tricity?
